			<content:encoded><![CDATA[<p>Joseph Safrany was serving a <strong>Florida DUI sentence</strong> of life in prison for a 2000 <a href="http://www.fightyourinjury.com/practice-areas/drunk-driver-accidents.html">drunk driving accident</a> that took the life of three people. The 45-year-old challenged the sentence with hand written arguments and by filing appeals after spending years behind bars reading law books. Safrany seemed to pull off a major shocker when he got a judge to grant him the opportunity for a new sentence but on Monday Circuit Judge Wayne Timmerman sentenced the man to 50 years in prison.<br />
Safrany was driving nearly 30 miles over the posted speed limit of 45 mph in April of 2007 when his Cadillac crashed with a Honda, which had four men inside including a driver who was drunk himself. Three of the men died including the driver of the Honda who also would have been facing <a href="http://www.fightyourdui.com/">Florida DUI charges</a> had he survived the crash. The three passengers who lost their lives were all between the ages of 19-23 and the group was returning from what TampaBay.com describes as a night out partying in Ybor City. The car was hit so hard by Safrany that it rolled 140 feet after the collision.</p>
<p><span id="more-250"></span><br />
Safrany suffered broken ribs in the accident and was released from jail of $55,000 bail. Friends threw him a party before his trial and then he vanished, living for more than a year under the identity of a dead man. He eventually turned himself in after he was shown on the TV show “America’s Most Wanted”.<br />
He was offered a plea deal that included <strong>DUI penalties</strong> of 15 years in prison for the manslaughter charge and another five years for being a fugitive. He turned that deal down. This time around his attorney was asking for the same 20 years Safrany was offered in a plea deal years ago. The offer was no longer extended to him by prosecutors and now he will most likely spend the rest of his life in prison.</p>

			<content:encoded><![CDATA[<p>Former Buccaneer tight end Jeramy Stevens is facing <strong>felony drug charges in Tampa</strong> for <a href="http://www.fightyourdrugcrime.com/marijuana_possession.aspx">marijuana possession</a> and possession of marijuana with intent to sell. Stevens was a member of the Buccaneers up until Monday when he was released from the team following the arrest. Stevens has had a history of run-ins with the law and the latest was the last straw for the Buccaneers who cut the tight end.<br />
Stevens was stopped Saturday night, about 18 hours before he was scheduled to be in uniform at Raymond James Stadium versus the St. Louis Rams. Tampa police pulled the 30-year-old over when there was loud music emanating from his Ford pick-up truck at Westshore Blvd. and Cypress Street. Officers approached the vehicle and reported smelling marijuana coming from the truck. That lead to a search of Steven’s truck. Officers found 38 grams of marijuana which led to <strong>felony marijuana charges</strong> being filed against the NFL player.</p>
<p><span id="more-249"></span><br />
Between 1998 and 2007 Stevens was involved in six police incidents. Included in those incidents was a 2000 arrest for <a href="http://www.fightyourcase.com/areas_of_practice/sex_crimes.aspx">sexual assault</a>. Charges were never filed in that case due to a lack of evidence. Stevens was convicted of three counts of DUI in Arizona in 2007.<br />
Police have filed charges of possession of drug paraphernalia, marijuana possession and possession of marijuana with intent to sell against Stevens. He posted $4,500 bail and was released from jail in Tampa. Stevens was not active to play against St. Louis Sunday. The next day the Buccaneers announced that Stevens has been released from the team. The tight end will most certainly be in line for league punishment if he is claimed by any other NFL squad, which seems unlikely at this point in time. Considering his legal problems and lack of production, Stevens most likely may have played his last NFL game.</p>

			<content:encoded><![CDATA[<p>Three men were arrested and charged with <strong>assault and battery in Hillsborough County</strong> following a <a href="http://www.fightyourcase.com/areas_of_practice/theft_crimes.aspx">Tampa robbery</a> at Charley’s Steak House on Cypress Street. The three men are in jail for allegedly robbing the steak house with an assault rifle outfitted with a bayonet. The police chase ended with one of the suspects leaping into Old Tampa Bay.<br />
The attempted robbery took place just after midnight and the suspects reportedly escaped the restaurant with a bag full of cash before jumping into a Lexus SUV. Police eventually caught up with the SUV that was reportedly involved in the robbery on the Howard Franklin Bridge. Officers were able to box the SUV in. At that point one of the men inside the silver Lexus got out of the vehicle and jumped off the bridge into the bay. The suspect was fished out of the water by police using a rope and his police cruiser’s rear seat which can be used a floatation device.</p>

TBO.com is reporting officers not only recovered a suspect from the water but also a bag of money and a weapon. Three men were arrested at the scene on charges that include robbery, aggravated battery, false imprisonment and <a href="http://www.fightyourbattery.com/areas_of_practice/aggravated_assault.aspx">aggravated assault</a>. One of the men who was arrested in connection with the <strong>Tampa restaurant robbery</strong> worked as a fry cook in the steak house. Another one of the suspects is a registered sex offender who was in prison for almost four years for a conviction on charges of lewd and lascivious behavior with a child between the ages of 12-15.<br />
The police were alerted to the robbery when a steak house employee called in the robbery report while hiding inside the restaurant’s dining room. Police were unsure at the time of the report which of the men was responsible for the robbery and which was the getaway car driver.</p>

			<content:encoded><![CDATA[<p>A Pinellas County Sheriff’s detective <strong>arrested a sex offender</strong> who was <a href="http://www.fightyourpinellasarrest.com/practice-areas/theft-crimes.aspx">shoplifting in Dunedin</a> Publix while wearing a deputy sheriff’s star. The 43-year-old Clearwater resident was stealing Halloween candy and kid’s sticker books while wearing a sheriff’s shield on his waistband.  He was spotted at the Publix Supermarket by a member of the sexual predator and offender tracking unit.<br />
The suspect exited the Publix and made his way to a car often driven by law enforcement, a Ford Crown Victoria. Authorities searched the car and found a pellet gun that looked like a 9 mm semi-automatic handgun. Also found in the car was an electric stun gun. The man was <strong>arrested in Pinellas</strong> on charges of shoplifting and unlawful use of a police badge.</p>
<p><span id="more-247"></span><br />
According to TBO.com he was also wanted on a <a href="http://www.fightyourwarrant.com/">Polk County arrest warrant</a> for two violations. The first was failure to appear on charges of driving with a revoked or suspended driver’s license. The second was a failure to appear on charges of possession of a firearm.<br />
Impersonating a police officer was one of the charges the suspect was convicted of in South Carolina in 1992. Along with that charge he was convicted of criminal sexual conduct, kidnapping and unlawful possession of a firearm. The pattern was enough to raise suspicion in his recent arrest, which seemed to mirror what he was convicted of almost 20 years ago. Detective Grubb was off-duty at the time he spotted the man in Publix.<br />
There was no further information on which county jail the convicted sex offender was being held or if he was able to post bail or bond. The only information contained in the on-line story about the arrestee was that he lives in a Clearwater apartment</p>

			<content:encoded><![CDATA[<p>A <strong>Hernando County drug bust</strong> has led to the arrest of a pharmacy owner from Lutz for violating <a href="http://www.fightyourdrugcrime.com/oxycodone-painkillers.aspx">Florida oxycodone laws</a> according to the St. Petersburg Times. The pharmacy owner was one of three people arrested for allegedly filling fake drug prescriptions out of the Glory Pharmacy in Spring Hill.<br />
The investigation into the Glory Pharmacy was described as months-long and it resulted in the arrest of the owner of the pharmacy, the pharmacist and one other employee. The investigation was conducted by the Florida Department of Health, the D.E.A. and the Hernando County Sheriff’s department. All three were booked into Hernando County jail on charges ranging from <strong>trafficking in Oxycodone</strong> to conspiracy to illegally dispensing a controlled substance.</p>
<p><span id="more-246"></span><br />
The drug bust was the result of an undercover sting involving detectives calling the pharmacy and asking to buy 180 oxycodone tablets, which the agent referred to as “blues”. A pharmacy employee allegedly told the undercover agent that the oxycodone would be available at the Spring Hill pharmacy. The agent brought a <a href="http://www.fightyourdrugcrime.com/prescription_fraud.aspx">fake prescription</a> with no DEA number and left with oxycodone. He also allegedly left with an offer for better prices on the drug if he brought in more customers. According to detectives, the agents bought a total of 179 pills of oxycodone from the pharmacy paying $720 in cash.<br />
The pharmacy owner and one employee were both being held on $500,000 bail, while the pharmacist was being held on $1,000 bond. Sheriffs told TampaBay.com that they do not believe that filling illegal prescriptions is a common practice at Florida pharmacies. That statement was issued despite the fact that there has been a huge increase in illegal prescription drug activity in Florida. There have been new laws passed in cities across the state barring further pain management clinics being opened and existing pain clinics have been raided all over Tampa Bay.</p>

			<content:encoded><![CDATA[<p>Two Tampa men are under arrest charged with multiple counts including <strong>aggravated assault</strong> on a firefighter after threatening two Tampa firemen and landing themselves in the <a href="http://www.fightyourtampadui.com/dui_information_center/jails_in_tampa.aspx">Hillsborough County jail</a>. The Tampa Tribune is reporting that Tampa firefighters were called out to a backyard fire when two men threatened them with a dog if they did not leave the property.<br />
The incident took place Saturday afternoon on Plymouth Street in Tampa. The fire was in the backyard and firefighters tried to enter the property in an attempt to get the fire under control. At that point two men with a dog on a long leash told the firefighters to leave the area or they would have the dog attack the firefighters. Things got even uglier at that point according to the on-line story when police arrived. One of the men began to tussle with police.</p>
<p><span id="more-245"></span><br />
The 25-year-old man who fought with police officers was arrested on charges of resisting an officer without violence, obstructing extinguishment of a fire and four counts of aggravated assault on a firefighter. The second suspect was also charged with aggravated assault on a firefighter, unauthorized fire and obstructing extinguishment of a fire as well. Both men were taken to Hillsborough County Jail and are facing <strong>criminal charges</strong>. Bail was set at $32,500 for each man.<br />
There was no mention as to why the men were so adamant about not allowing firefighters to enter the backyard. There is nothing mentioned in the TBO.com story about police discovering anything illegal in the backyard at the time of the pair’s <a href="http://www.fightyourcase.com/hillsborough_defense.aspx">Hillsborough County arrest</a>. There was also no mention of what was on fire in the Plymouth Street home, which also may have provided some insight as to why the arrestees would risk going to jail to stop firefighters from extinguishing the blaze.</p>

The only problem is the friend they tried to stop from drunk driving got so mad he hit one of his friends with a car and then beat him up leading to <a href="http://www.fightyourbattery.com/areas_of_practice/aggravated_battery.aspx">aggravated battery charges</a> among other charges.<br />
According to Bradenton.com, Severiamo Ruiz was at a party and was preparing to drive off at approximately 3:00 a.m. Sunday morning. Two of his friends, fearing he would be <a href="http://www.fightyourdui.com/">stopped for a DUI</a>, tried to persuade him not to drive. Despite the effort of his friends, one male and one female, Ruiz still got behind the wheel and left the party.</p>

Ruiz took off in his car and his friends gave chase in their own vehicle in hopes of somehow getting their drunk friend off the road. Sheriffs’ reports show the pair did get the drunk driver to pull over on 14th Street West in a parking lot. They may have wished they were unable to stop Ruiz considering what happened next. Ruiz put his car in reverse and ran into his male friend. The car knocked the man to the ground. Ruiz not only ran over his friend causing a head laceration, he decided to get out of the car and start to beat his friend up. He got back in his truck and began to drive towards both his male and female friend. He ran into a building and drove off before police arrived on the scene.<br />
Ruiz was arrested and charged with numerous <strong>Manatee County battery charges</strong>. He was taken to Manatee County jail on charges of aggravated assault with a vehicle, simple battery and aggravated battery with a vehicle. His bond was set at $47,000.</p>

The school is issuing forms that students and parents have to sign. The forms say the student will promise not to consume alcohol and if they do they could be subject to having to take a breathalyzer test.<br />
The form is causing some controversy among the students but seems to be supported by the parents interviewed by Bay News 9. Students believe the form is a violation of their rights in the sense that it makes them submit to <strong>alcohol breath testing</strong>. A few of the students interviewed by Bay News 9 felt that alcohol breath tests were taking things a little too far.</p>

As one would expect, the parents of the students that were interviewed did not have nearly as big of a problem with the form or the breath testing. With underage drinking and the dangers that come along with that like <a href="http://www.fightyourinjury.com/practice-areas/drunk-driver-accidents.html">DUI accidents</a>, parents seems to feel like whatever the school wants to do to protect their children, they are OK with it.<br />
The legal analyst consulted for the Bay News 9 report stated he believed the form was completely legal. Joe Episcopo said students don’t have full constitutional rights while on school property so in his opinion the request by the school made in these forms does not cross the line. The American Civil Liberties Union (ACLU) slightly disagreed. The ACLU voiced concern over the vagueness of the form and the way it would be implemented. Their spokesperson hopes the form won’t give way to mass breath tests without reasonable suspicion that a student has been drinking.<br />
This is not the first time this form has been used according to the Pinellas County School Board. Their spokesperson said the same form was used for the prom earlier this year.</p>

			<content:encoded><![CDATA[<p>News is just coming out about a Saturday night <strong>Sarasota DUI arrest</strong> involving a firefighter who was involved in a <a href="http://www.fightyourdui.com/dui_defense/dui-property-damage.aspx">DUI crash</a> around 1:00 a.m. The Sarasota Herald Tribune is reporting the story of 24-year-old Derek Patrick Maxwell and his drunk driving crash that led to his arrest while in his department gear.<br />
According to the newspaper’s website, Maxwell was on Lakewood Ranch Boulevard and University Parkway when he apparently flipped his vehicle striking trees and bushes in the median at approximately 1:00 a.m. He was arrested four hours following the <strong>DUI wreck</strong> and charged with DUI with property damage.</p>

Maxwell made no secret he had been drinking prior to the accident according to the police report. According to the story he claimed to have drunk two shots of Wild Turkey and six beers at a local restaurant. Maxwell was allegedly in his full firefighter uniform at the scene of the accident. Two Sarasota County fire chiefs showed up on the scene of the crash to reportedly pick up department belongings from the scene. The officials said that the young firefighter was in the midst of wild mood swings while they were on the scene. He went from shouting to banging his head on a patrol car window to crying.<br />
The Florida Highway Patrol noticed that Maxwell had urinated in his pants after he removed his firefighter uniform. They also reported an <a href="http://www.fightyourdui.com/dui_defense/initial_police_contact.aspx">odor of alcohol</a> that was so strong they described the smell as nauseating. Maxwell freely admitted to the officers that he had planned on blaming the Sarasota Sheriff’s office for framing him to avoid the DUI arrest. There was no mention of the amount of bail in the case or if and when Maxwell was released from Sarasota County Jail. The Sarasota County Fire Department was not quoted in the story either concerning Maxwell’s job status following the arrest.</p>

			<content:encoded><![CDATA[<p>Apparently Pasco Sheriff’s deputies had a hunch there was a <strong>marijuana grow house</strong> near Gulf High School and after obtaining a <a href="http://www.fightyourdrugcrime.com/search_and_seizure.aspx">search warrant</a> their suspensions were proved correct. According to TBO.com deputies raided a house at 5241 School Road yesterday morning and ended up discovering a grow house operation and arresting 40-year-old Jeff Wagner.<br />
While searching Wagner’s home deputies found nearly 80 marijuana plants being grown hydroponically. There were also more than nine ounces of pot in jars, more than an ounce of loose marijuana, a small amount of pot in a baggie and a joint. Sheriff’s deputies also discovered Xanax along with drug paraphernalia like rolling papers and pipes.</p>

Wagner allegedly admitted to owning and operating the grow house. He also apparently told arresting officers that he learned how to operate the grow house from the Internet. According to the article and police reports, it is not believed that Wagner sold marijuana to any of the high school students attending school near his home. Sheriff’s spokesperson Mr. Doug Tobin confirmed the suspicions telling the TBO.com reporter that it didn’t appear Wagner had any students from Gulf High School as clients.<br />
Following the<strong> Pasco drug bust </strong>Wagner is facing numerous <a href="http://www.fightyourcase.com/areas_of_practice/drug_cases.aspx">Florida drug charges</a>. According to the story he has been charged with possession of drug paraphernalia, possession of marijuana with intent to sell, cultivation of marijuana and possession of a controlled substance. Wagner was booked into the Land O’ Lakes jail. He returned home after posting bail of $12,150. He was reached by TBO.com but declined to comment about the drug arrest or charges he is facing. He did however make a point of saying the marijuana operation had nothing to do with the high school located near his home. Depending on how close Wagner’s home is to the school, there could be stiffer penalties and charges involved with dealing drugs too close to a school.</p>
